Over the course of the past several years, many states across the Union have declared a mandate that all employers, public and private, will use E-Verify in their employment screening process.   This list includes Mississippi, Alabama, South Carolina, Tennessee, Georgia, Utah and North Carolina.  In 7 other states, all state agencies and state contractors have this requirement, and in two additional states, only state contractors must use E-Verify when conducting background checks.

In recent days, California Governor Jerry Brown has gone against what many other states have created and signed a bill which prohibits the mandated use of E-Verify in California.  Several cities and counties in California have created their own E-Verify mandates.  Now, every city and county in California is prohibited from mandating the use of E-Verify as a part of a background check process, except for government entities.  It is important to note that California employers can still use E-Verify when conducting employment screenings.  This law simply prohibits city or county governments from forcing any employer to use E-Verify.

This bill comes at a time when employers are more concerned than ever about the bottom line.  These types of mandates make the hiring of an employee that much more costly, and make the company hesitant to open up possible job opportunities because of additional hiring costs.  Titled the “Employment Acceleration Act of 2011,” the purpose of this bill is to allow employers to know they can make a hire without the concern of being levied the additional cost of E-Verify.  With this new bill in mind, many employers will continue to utilize an extensive background check process, which includes criminal searchesdrug testingemployment verifications and many other employment screening options.  The benefit of using PeopleG2 for your background check needs is that an employment screening package can be created, with or without E-Verify, that meets your company’s needs at a cost you can afford.
