There has been a lot of discussion recently, much of it stemming from the EEOC, about the use of criminal records in employment decisions. The EEOC has presented its guidelines stating that not every problem with the law will automatically rule you out of a position.
Recently, I had the opportunity to discuss this issue in an article for eFinancial Careers as it relates to obtaining employment in the financial services industry, even if an applicant has a criminal record. The bottom line is that there are several factors that must be considered before deciding to refuse employment in this area. Obviously, if there is a record indicating any sort of mishandling of funds, theft or other things that are industry specific, then an offer might be in question as this sort of criminal past can easily be used to deny employment. If the criminal record was a result of other types of behavior, then these things need to be looked at and evaluated to see if they directly impact the ability of this person to do the job.
