All employers are required to complete a Form I-9 for each employee hired in the United States in order to comply with their employment eligibility verification responsibilities.  The U.S. Citizenship and Immigration Services has published a new Form I-9 (Rev. 03/08/13), and all employers are encouraged to begin using this form immediately in their employment screening for all new hires and re-verifications.

For those companies that utilize E-Verify as a part of their employment screening process, as well as those that fill our Form I-9 for general employment purposes, it is important that you are utilizing the most up to date Form I-9.  The USCIS and the Department of Homeland Security is mandating its use as of May 7, 2013.  Performing an I-9 verification through E-Verify as a part of a background check is not federally mandated, however, several cities and states have made it a mandatory practice.  For those companies that do it voluntarily, they are taking the extra step in protecting their business by making it a part of their employment screening package.

The newly revised Form I-9 now contains data fields, including the employee’s foreign passport information (if applicable) and telephone and email addresses.  They have also improved the form’s instructions to provide a better description of the information needed in each section.  Lastly, the layout of the form has been revised, going from one to two pages, which does not include the instructions and list of acceptable documents.

It is important to ensure that you are compliant with the use of this form by May 7, 2013.  Having a completed Form I-9 on every employee is a required part of the hiring process, and taking the step of utilizing E-Verify is a great addition to any background check.
